This notice explains how Mira srls ownership of Buboisè, a company incorporated under Italian law, with registered office at Savio 1656,47522 Cesena (FC). Buboisè processes the personal data of users of “www.buboise.com” website in accordance with EU legislation on data protection, Article 13 of the Italian Privacy Code (Legislative Decree No. 196/2003) and the data protection law applicable in your country (“Privacy Laws”).

a)     data controller

Buboisè will process the personal data of users registered to the Website, as autonomous data controller, for marketing (please see paragraph b) point iii) below). The e-commerce services offered through Buboisè.com are instead managed by Buboisè which acts as data controller of data regarding online purchases. Specifically Buboisè oversees the management of all purchase steps on the Website, including payment and user registration; and (ii) Buboisè oversees shipping, delivery, management of returns and after-sale support. The data you provide to purchase online, such as your credit card details, will be processed exclusively Buboisé.

b)     purposes and methods of processing

Buboisè may process your data collected during browsing and use of the Website for the following

purposes:

i. to fulfil its legal obligations, and other obligations arising from instructions received from authorities;

ii. to fulfil, obligations strictly connected to the use of, and instrumental to enable the use of, the Website (for example, registration on the Website), as well as to manage the contractual relationship, purchase of products and accessories online, and any subsequent after-sale assistance; and

iii. to send newsletters or to carry out marketing, through promotions relating to Buboisè, local affiliates Buboisè’s group, Buboisè’s partners, and Buboisè’s products and services, by email, post, telephone, SMS or social media (for example, to be updated on Buboisè’s new products and to find out about events, contests, demonstrations, loyalty programmes, etc. organised by Buboisè), also by using automated means. Such communications will relate to products and services of the fashion, luxury goods and the like. If you prefer to receive marketing communications by traditional means only (i.e., by post or telephone), please email privacy@buboise.com. In addition, Buboisè will process the personal data you provide through your registration on the Website; for market research, statistical analyses, or other research to improve its products, and customer satisfaction analysis.

Your personal data may be processed either electronically or in hard copy form, both in and outside the EU, since this programme is managed and provides clients with Buboisè’s benefits worldwide (for more details about the Buboisè’s safety system in non-EU countries see point d) below).

Your personal data will be kept for a period not exceeding that necessary for the purposes for which they were collected, after which they will be destroyed or rendered unusable.

c)     Mandatory vs. optional data and consequences of not providing data

You must provide your data for the purposes set out under points b) (i) (legal purposes) and (ii) (contractual purposes). If you do not wish Buboisè to process your data for those purposes, Buboisè will respect this. However, in this event you will be unable to purchase products online or use any additional services that Buboisè offers registered users. Providing data for the purposes set out under point b) (iii) (marketing purpose) is optional. Not providing your data for this purpos will not have any negative consequences for you.

or which may become aware of the data as data processors or persons in charge of processing; scope of dissemination of the data; transfer to non-eu countries

The data provided by the user will be processed only by staff designated for that purpose or by Buboisè’s (including Buboisè affiliated companies) and Digital River’s data processors, exclusively in order to carry out the activities for which the data was collected (for example, to execute online purchase orders). The data may be processed by third parties carrying out activities connected with or instrumental to Buboisè’s activities, as independent controllers or data processors (the “Processors”) appointed by Buboisè. The third parties may, for example, be providers of electronic communications services, banks, financial intermediaries, credit institutions, other financing entities, centralised information system operators (web platform operators, hosting service operators, anti-fraud or risk centres, etc.), insurance companies, consultants and self-employed professionals assisting Buboisè in credit collection and dispute management, companies that perform packaging, shipping and/or delivery or direct mailing services, research entities and companies, associations, or non-profit foundations. If you consent to the processing of your personal data for the purpose above, your personal data inserted in Buboisè’s database will be automatically accessible to all Buboisè sales staff based at the points of sale worldwide as it supports Buboisè with its business activity.

Given the global nature of this programme, some of the affiliated companies and partners of Buboisè that act as Processors on behalf of Buboisè and, as such, access to your data are established in countries outside the European Union and the European Economic Area and, therefore, might not provide a level of data protection equal to that established in the EU. ii. to update, correct, supplement, or delete the data, to block or render anonymous data that have been processed unlawfully, including data whose retention is unnecessary for the purpose for which such data have been collected or subsequently processed; to certify that the operations requested have been completed, as also related to their contents, to the entities to which the data were communicated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected; and
